Terms of Service

Welcome to PoolQ. These Terms of Service (“Terms”) govern your use of the PoolQ website, software, and any associated hardware provided by us (collectively, the “Service”). By signing up for an account, subscribing to a plan, or using our Service, you agree to be bound by these Terms.
1. Description of Service
PoolQ provides a venue management and checkout system for pool halls and similar establishments.
- For Venues: You pay a flat monthly subscription rate for access to the PoolQ software. You retain 100% of your established table rates.
- For Players (End Users): Players are charged a nominal service fee by PoolQ at the time of checkout.
2. Subscription Plans and Billing
All PoolQ subscription plans are billed on a month-to-month basis.
- No Long-Term Contracts: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing cycle. We do not offer prorated refunds for mid-month cancellations.
- Payment Authorization: By providing a payment method, you authorize us to charge your applicable monthly subscription fee, plus any upfront hardware or activation fees, on a recurring basis.
3. Hardware Terms
Depending on the subscription plan you select, the following hardware terms apply:
A. Software Only (BYOD)
You are responsible for sourcing, configuring, and maintaining your own compatible tablet, stand, and related equipment. PoolQ is not responsible for the performance, maintenance, or replacement of your personal hardware.
B. Standard Plan (Leased Hardware)
Under the Standard plan, PoolQ provides a pre-configured Android tablet, commercial rugged case, and counter stand.
- Ownership: This hardware remains the exclusive property of PoolQ and is leased to you for the duration of your active subscription.
- Replacements: We will replace hardware free of charge in the event of manufacturer defects or normal wear and tear. This does not cover damage caused by negligence, abuse, spills, drops outside the case’s threshold, or intentional destruction (e.g., a customer hitting it with a pool cue).
- Return of Hardware: Upon cancellation of your Standard plan, you must return all provided hardware to PoolQ in reasonably good condition within 30 days, or you will be charged a non-returned equipment fee of $100.
C. Pro Plan (Hardware Purchase)
Under the Pro plan, you purchase the tablet, rugged case, and stand upfront for a one-time fee.
- Ownership: Once paid in full, the hardware is yours to keep.
- No Replacements: Because you own the hardware outright, PoolQ does not provide free replacements for damaged, lost, or defective equipment. Any manufacturer warranties are between you and the original hardware manufacturer.
4. Venue Responsibilities
- Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- Internet Connection: PoolQ requires a stable internet connection to process transactions and sync data. You are responsible for maintaining a reliable network environment at your venue.
5. Limitation of Liability
To the maximum extent permitted by law, PoolQ shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or lost data, arising out of your use of the Service or any hardware failure.
6. Modifications to the Service and Pricing
We reserve the right to modify or discontinue the Service (or any part thereof) with or without notice. We may also update our pricing and subscription tiers; however, any price changes will be communicated to you at least 14 days in advance of your next billing cycle.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
